BRANDING AND TRADE NAME
The Platform may be presented to users under the brand name “Hema” (including domain names, applications, interfaces, and marketing materials). All rights, obligations, and legal responsibilities described in these Terms are undertaken by SAFETRIP TRAVEL AND CONSULTANCY LIMITED, regardless of the brand name used in the user interface.
1. IMPORTANT NATURE OF THE PLATFORM
1.1 What SafeTrip is
SafeTrip is a digital legal-support and case-coordination platform for travelers. Based on the current product design, the Platform offers, among other things:
- 24/7 AI-powered legal support;
- document upload and AI-assisted document analysis;
- non-legal support coordination by operators;
- escalation to licensed local lawyers or law firms where available;
- communication, case tracking, and support tools related to travel-related legal issues.
1.2 What SafeTrip is not
Unless expressly stated otherwise in a separate written engagement, SafeTrip:
- is not itself a law firm, bar association member, advocate bureau, or legal-aid authority;
- does not itself provide court representation, attorney-client representation, or regulated legal practice in jurisdictions where such activities require local admission, licensing, or other authorization;
- is not an insurer, insurance broker, or insurance underwriter, and the Platform plans are not insurance policies;
- does not guarantee any legal outcome, authority response, case result, or recovery.
1.3 AI limitations
The AI features are designed to provide general legal orientation, issue spotting, document summarization, and workflow assistance. AI outputs may be incomplete, inaccurate, outdated, mistranslated, or unsuitable for your specific circumstances. AI outputs must not be treated as a substitute for advice from a qualified lawyer licensed in the relevant jurisdiction.
1.4 Local-law dependencies
Legal rights, procedures, deadlines, reporting obligations, and available remedies vary by country and by the facts of each case. Availability of lawyer escalation, language support, urgency handling, and on-site attendance depends on local partner availability, lawfulness, operational constraints, geography, and third-party acceptance.
2. ELIGIBILITY AND ACCEPTABLE USERS
2.1 Eligibility
You may use the Platform only if:
- you have legal capacity to enter into a binding contract under the laws applicable to you;
- you are at least 18 years old, or you are using the Platform through a parent, guardian, employer, or other authorized representative who validly accepts these Terms on your behalf;
- your use of the Platform does not violate applicable sanctions, export controls, anti-money laundering rules, anti-fraud rules, or other applicable law.
2.2 Business users
If you use the Platform on behalf of a travel agency, tour operator, employer, insurer, platform partner, or other legal entity, you represent that you are authorized to bind that entity, and references to “you” include both you and that entity.
2.3 Restricted use
You may not use the Platform if you are seeking assistance for:
- unlawful conduct by you;
- evasion of immigration, customs, tax, or law-enforcement obligations;
- submission of false, misleading, forged, or manipulated documents;
- harassment, abusive conduct, or malicious complaints;
- activities restricted by applicable sanctions or prohibited-party rules.
3. TERRITORIAL SCOPE AND SERVICE AVAILABILITY
3.1 Initial geographic focus
The Platform may initially prioritize service availability, support flows, pricing, content, or legal network coverage for users traveling in or connected to Türkiye. However, Platform availability does not mean that all services, languages, lawyers, escalation modes, or case types are available in all countries or cities.
3.2 Cross-border structure
SafeTrip may operate cross-border with technology, support, and partner-lawyer layers located in different jurisdictions. Lawyer services, where offered, are performed by separate local professionals or firms under separate professional obligations and local rules.
3.3 Country-specific restrictions
Certain jurisdictions may prohibit or regulate legal referrals, success-based fees, legal advertising, remote legal intake, on-site legal attendance, or handling of sensitive case categories. SafeTrip may limit, suspend, or refuse features in order to comply with local law or partner requirements.
4. ACCOUNT REGISTRATION AND SECURITY
4.1 Registration
To use certain features, you must create an account and provide accurate, current, and complete registration information. You must keep that information updated.
4.2 Verification
We may require verification of your email address, phone number, identity, travel status, booking data, or authority to act for another person before activating certain plans, processing escalations, or sharing your case with a lawyer.
4.3 Account security
You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activity under your account;
- promptly notifying us of unauthorized access or suspected compromise.
We may suspend or disable accounts if we reasonably suspect fraud, abuse, credential compromise, sanctions risk, payment risk, or breach of these Terms.
5. DESCRIPTION OF SERVICES
5.1 AI Consultation
The Platform may allow you to describe your situation in your own language and receive AI-generated guidance, including issue-spotting, rights-and-risks summaries, procedural explanations, next-step suggestions, and general orientation.
5.2 Document Analysis
You may upload notices, contracts, fines, police documents, letters, complaints, or other materials. The Platform may use AI tools and/or human review workflows to extract, translate, summarize, classify, and draft responses based on those materials.
5.3 Operator Support
Support operators may help with account navigation, workflow guidance, translation support, status updates, and escalation coordination. Operators are not your lawyers unless explicitly identified otherwise.
5.4 Escalation to Licensed Lawyers
Where available and appropriate, SafeTrip may offer escalation to a licensed local lawyer or law firm. Such escalation may be included in a plan, subject to quotas, or priced separately on a pay-per-case, pay-per-day, or hourly basis.
5.5 On-site legal support
If the Platform offers urgent in-person attendance or on-site legal assistance, such services are subject to local law, geography, lawyer availability, timing, safety conditions, third-party acceptance, and separate pricing.
5.6 No emergency services
The Platform is not an emergency dispatch service and is not a substitute for police, ambulance, consular, embassy, fire, or other emergency authorities. If you are in immediate danger or require urgent emergency intervention, contact local emergency services immediately.
6. NO ATTORNEY-CLIENT RELATIONSHIP WITH SAFETRIP
6.1 Platform relationship only
Your acceptance of these Terms and your use of the Platform create a contractual relationship with SafeTrip for technology, support, coordination, and access services only.
6.2 Separate lawyer engagement
An attorney-client or equivalent lawyer-client relationship arises only if and when a licensed local lawyer or law firm expressly accepts your matter under a separate engagement, subject to that lawyer’s or firm’s local rules, conflict checks, ethical duties, scope, and fee terms.
6.3 No guarantee of lawyer acceptance
Submission of a request for escalation does not guarantee that a lawyer will accept your matter, be conflict-free, be immediately available, or be able to act within a deadline.
6.4 No legal privilege with all Platform communications
Not all communications made through the Platform are protected by legal professional privilege. Privilege may attach only in limited circumstances, usually after engagement by a qualified lawyer and subject to local law.
7. USER OBLIGATIONS
You agree to:
- provide truthful, complete, and non-misleading facts and documents;
- respond promptly to requests for clarification or verification;
- comply with all applicable laws in the relevant jurisdiction;
- avoid uploading malware, unlawful material, forged documents, or confidential data you are not authorized to share;
- refrain from abusive, discriminatory, threatening, defamatory, or unlawful behavior toward support staff, operators, lawyers, or third parties.
You are solely responsible for:
- decisions you make based on Platform outputs;
- deadlines, filings, attendance obligations, or authority interactions unless a local lawyer expressly undertakes responsibility for them in writing;
- preserving original documents and evidence.
8. DOCUMENTS, CONTENT, TRANSLATIONS, AND SUBMISSIONS
8.1 Your content
You retain ownership of content and documents you upload, but you grant SafeTrip a non-exclusive, worldwide, royalty-free license to host, store, reproduce, translate, analyze, transmit, and process such materials as needed to operate, secure, improve, and provide the Platform and support workflows.
8.2 Sensitive content
Do not upload information you are prohibited from sharing. If you upload data relating to third parties, you represent that you have an appropriate legal basis or authorization to do so.
8.3 Machine translation and AI drafting
Translations, summaries, extracted data points, and drafted replies may contain errors. You must review all drafts carefully before sending or relying on them.
8.4 Monitoring and compliance
We may review content to enforce these Terms, protect users, prevent fraud, comply with law, respond to lawful requests, or maintain Platform integrity.
9. FEES, PLANS, PRICING, AND BILLING
9.1 Plan types
The Platform may offer, for example:
- subscription plans for a fixed period (such as 30-day trip coverage or monthly access);
- personal-assistant or premium plans;
- pay-per-case, pay-per-day, hourly, or urgent-add-on services;
- business, agency, white-label, or volume packages.
9.2 Pricing disclosure
Applicable prices, currencies, taxes, plan duration, included features, usage caps, escalation rights, and add-on fees are shown at checkout or in a written order form. Prices may differ by country, channel, campaign, currency, and partner arrangement.
9.3 Taxes and charges
Unless stated otherwise, prices may exclude local taxes, bank fees, card fees, crypto network fees, FX spreads, or charges imposed by third-party payment providers.
9.4 Payment methods
We may accept card payments, local payment methods, and selected digital assets or cryptocurrency. If you choose to pay in cryptocurrency, you bear blockchain fees, market volatility, wallet/address accuracy risk, and any conversion charges unless expressly stated otherwise.
9.5 Authorization
By submitting payment information, you authorize SafeTrip and its processors to charge the applicable fees and taxes using your chosen payment method.
9.6 Failed or reversed payments
If payment fails, is reversed, or is subject to chargeback, dispute, clawback, or fraud review, we may suspend access, cancel the order, recover costs, or withhold escalation until payment risk is resolved.
10. SUBSCRIPTIONS, RENEWALS, TERM, AND TERMINATION
10.1 Subscription term
Subscription plans begin on the date of activation and continue for the stated term.
10.2 Renewal
If a plan is described as auto-renewing, it will renew for successive periods unless cancelled before renewal. Where required by applicable law, we will obtain the necessary consent or provide the required notice before renewal.
10.3 Your cancellation
You may cancel auto-renewal at any time through your account or by contacting support. Unless applicable law requires otherwise, cancellation stops future renewals and does not retroactively cancel the current paid term.
10.4 Our suspension or termination rights
We may suspend, restrict, or terminate all or part of your access immediately if we reasonably believe you violated these Terms, created legal or security risk, abused staff or lawyers, uploaded unlawful content, or failed required verification.
10.5 Survival
Sections that by their nature should survive termination will survive, including payment, IP, disclaimers, limitation of liability, disputes, and governing law provisions.
11. CONSUMER WITHDRAWAL, CANCELLATION, AND REFUND POLICY
This Section is intentionally detailed because the Platform sells digital, remotely contracted services that may be purchased by consumers before or during travel.
11.1 Statutory rights preserved
Nothing in these Terms limits non-waivable rights you may have under applicable consumer-protection law, including rights that may apply under Turkish consumer and distance-contract rules where those rules are applicable to your purchase or use of the Platform.
11.2 Consumer cooling-off framework
Where Turkish consumer distance-contract rules apply and no statutory exception applies, consumers generally have a 14-day right of withdrawal from distance contracts, exercisable without penalty and without giving a reason, by sending a clear notice using a durable medium. Official Turkish consumer guidance also states that the provider must return amounts due following a valid withdrawal notice within 14 days. You may also have access to Turkish consumer complaint channels, including the Consumer Arbitration Committees for disputes under the applicable monetary threshold. For 2026, the Ministry of Trade announced a threshold of TRY 186,000 for such applications.
11.3 Immediate-performance acknowledgement for digital services
Because SafeTrip provides digital and support services that may begin immediately after purchase (including account activation, AI access, support availability, document analysis readiness, and case intake), checkout should require a clear confirmation from the consumer, where legally required, that:
- performance may begin before the withdrawal period expires; and
- to the extent permitted by applicable law, the consumer may lose or have reduced withdrawal rights once the service has been fully or partially performed.
11.4 When withdrawal may be unavailable or reduced
To the extent permitted by applicable law, and especially where the consumer expressly requests immediate performance before expiry of the withdrawal period, SafeTrip may refuse or proportionally reduce a refund for services already performed, activated, consumed, reserved, or irreversibly delivered, including:
- account activation and plan activation;
- AI consultations already used;
- document analysis already initiated or completed;
- operator time already spent;
- lawyer matching, intake, conflict checks, or coordination already initiated;
- booked consultations, urgent routing, or on-site dispatch efforts already arranged;
- crypto network fees, processor fees, banking fees, or third-party charges already incurred where legally non-refundable.
11.5 Recommended operational refund model for the Platform
For consistency and consumer transparency, the Platform should implement the following commercial model, subject always to mandatory local law:
(A) Before activation / before use
If the user purchases a plan and the plan has not been activated, no AI consultations have been used, no documents uploaded, no operator work started, and no escalation initiated, provide a full refund.
(B) After activation but before substantive use
If the plan is activated but no meaningful service has yet been consumed, SafeTrip may either:
- provide a full refund as a goodwill commercial policy; or
- deduct only unavoidable third-party transaction or network fees if clearly disclosed in advance and permitted by law.
(C) After partial use
If the user has started using the Platform during the withdrawal period, any refund should be calculated proportionally based on the services already performed and the value already delivered, to the extent permitted by law.
(D) After full consumption or case-specific performance
If the purchased service has been fully delivered, substantially consumed, or is tied to a case-specific urgent intervention already performed, the fee may become non-refundable to the extent allowed by law.
11.6 Subscription cancellation vs. refund
Cancelling a subscription stops future renewal. It does not automatically entitle the user to a refund for the current active term unless required by law or expressly stated in a promotional offer.
11.7 Pay-per-case and lawyer fees
Fees charged for pay-per-case escalation, lawyer time, urgent handling, booked consultations, on-site attendance, or other case-specific services may be subject to separate cancellation and refund rules presented at the time of booking. Once a local lawyer or law firm has started work, separate lawyer terms may apply and some or all fees may become non-refundable.
11.8 Business users
Unless a written B2B order form states otherwise, purchases made by travel agencies, operators, employers, or other business users are non-cancellable and non-refundable once the relevant package, seat allocation, usage allotment, integration, or reserved capacity has been activated.
11.9 Promotions and credits
Promotional discounts, trial offers, referral credits, goodwill credits, and non-cash account balances are not redeemable for cash unless required by law.
11.10 How to request cancellation or refund
Refund, cancellation, and withdrawal requests must be submitted through the contact methods identified on the Platform or by email to the support address shown in these Terms. For compliance purposes, requests should be made in writing or another durable medium and should include sufficient identifying information to locate the transaction.
11.11 Refund timing and method
Where a refund is due, SafeTrip will process it to the original payment method unless otherwise required by law or operationally impossible. Processing times may depend on banks, card schemes, crypto network confirmation, wallet validity, and payment processors.
11.12 Chargebacks
You agree to contact SafeTrip first to seek resolution before initiating a chargeback, where reasonably possible. We reserve the right to dispute chargebacks where services were delivered, fraud is suspected, or the claim conflicts with these Terms or applicable law.
11.13 No waiver of mandatory law
If local law grants you stronger withdrawal or refund rights than these Terms, local law prevails.
12. INTELLECTUAL PROPERTY
The Platform, including software, layout, source and object code, prompts, workflows, branding, graphics, data compilations, and content made available by SafeTrip, is owned by or licensed to SafeTrip and protected by intellectual-property laws.
You receive a limited, non-exclusive, non-transferable, revocable right to access and use the Platform for its intended purpose during your valid subscription or access period. You may not:
- copy, reverse engineer, scrape, frame, resell, sublicense, or exploit the Platform;
- train competing AI models on Platform outputs or content unless explicitly authorized;
- remove or alter proprietary notices.
13. THIRD-PARTY SERVICES AND PARTNER LAWYERS
The Platform may rely on third-party providers for hosting, communications, payments, identity checks, translation, analytics, AI models, or case routing. We are not responsible for independent third-party systems outside our reasonable control.
Any local lawyer, law firm, expert, translator, mediator, or other professional introduced through the Platform is an independent professional or entity, not an employee of SafeTrip unless expressly stated otherwise.
14. PRIVACY, DATA PROTECTION, AND RECORDINGS
Your use of the Platform is also governed by our Privacy Policy. Depending on the markets served and the data involved, data handling may be subject to Turkish personal-data rules, including Law No. 6698 on the Protection of Personal Data (KVKK), and/or other applicable data-protection rules.
You acknowledge that the Platform may process personal data, contact data, travel data, case data, documents, and in some cases sensitive or special-category data strictly as necessary to operate the Platform, comply with law, detect fraud, and coordinate support.
Calls, chats, uploads, or support interactions may be logged or recorded where lawful and appropriately disclosed.
15. COMPLIANCE, AML, SANCTIONS, AND FRAUD CONTROLS
We may conduct screening, risk checks, identity checks, fraud reviews, sanctions reviews, or usage monitoring, directly or via service providers, where reasonably necessary to comply with law, payment rules, or partner requirements.
We may refuse service, block access, or freeze certain workflows where required by sanctions, export controls, payment-provider restrictions, fraud concerns, or legal prohibitions.
16. DISCLAIMERS
16.1 Informational service
Except where a separate lawyer engagement exists, the Platform is provided for informational, support, workflow, coordination, and technology purposes only.
16.2 No warranty
To the maximum extent permitted by law, the Platform is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation.
16.3 No guarantee of outcome
We do not warrant that:
- AI outputs are accurate, complete, or current;
- any lawyer will accept your matter;
- any deadline will be met unless expressly assumed in writing by the relevant professional;
- any authority, airline, insurer, hotel, landlord, police officer, court, or third party will adopt or honor any output or recommendation.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by law, SafeTrip and its directors, officers, employees, contractors, and affiliates are not liable for indirect, incidental, special, punitive, consequential, or loss-of-profit damages, or for loss of data, goodwill, business, opportunity, or reputation arising out of or related to the Platform.
Subject to non-waivable law, SafeTrip’s aggregate liability for claims arising out of these Terms or the Platform will not exceed the total amount actually paid by you to SafeTrip for the specific service giving rise to the claim during the six (6) months preceding the event giving rise to liability.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including certain consumer rights or liability for fraud or willful misconduct where non-excludable.
18. INDEMNITY
You agree to indemnify and hold harmless SafeTrip and its affiliates from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from:
- your breach of these Terms;
- your unlawful use of the Platform;
- your false statements, forged documents, or unauthorized data sharing;
- claims by third parties resulting from materials or instructions you submit.
19. COMPLAINTS, CONSUMER RIGHTS, AND DISPUTE RESOLUTION
19.1 Customer support first
If you have a complaint, please contact SafeTrip first so we can attempt to resolve it promptly.
19.2 Consumer complaint routes
Where Turkish consumer law applies, consumers may have rights to apply to Turkish Consumer Arbitration Committees for disputes within the statutory monetary threshold and may access official complaint tools through Turkish government channels. Depending on the dispute type, Turkish law may also require or encourage mediation before court proceedings in certain categories of disputes.
19.3 Business disputes
Unless mandatory law requires otherwise, disputes with business users should first be escalated to senior representatives for good-faith negotiation for at least thirty (30) days before formal proceedings.
20. GOVERNING LAW AND JURISDICTION
20.1 Consumer mandatory law carve-out
Nothing in this Section deprives a consumer of mandatory protections under the law of the consumer’s habitual residence or other mandatory law that applies notwithstanding a contractual choice of law.
20.2 Governing law
These Terms are governed by the laws expressly stated in the applicable checkout, order form, or local terms addendum. If no different local addendum applies, these Terms are governed by the laws applicable to SAFETRIP TRAVEL AND CONSULTANCY LIMITED in the jurisdiction of its incorporation, excluding conflict-of-laws rules, subject always to mandatory consumer law.
20.3 Venue
Subject to mandatory consumer law and mandatory local jurisdiction rules, disputes shall be submitted to the competent courts identified in the applicable local addendum or, absent such addendum, the competent courts of the operator’s jurisdiction of incorporation.
Drafting note: Before launch, this governing-law section should be finalized by local counsel to align with: (i) the company’s place of incorporation; (ii) the country-specific consumer markets targeted (including Türkiye); and (iii) the actual contracting entity shown at checkout.
21. CHANGES TO THE PLATFORM OR TERMS
We may update the Platform, plans, pricing, partner network, features, or these Terms from time to time. If changes are material, we will provide notice by appropriate means, such as website notice, account notice, or email. Your continued use after the effective date of updated Terms constitutes acceptance of the updated Terms, except to the extent prohibited by law.
22. GENERAL PROVISIONS
- If any provision is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce a provision is not a waiver.
- You may not assign these Terms without our prior written consent; we may assign them in connection with a reorganization, merger, sale, or transfer of business.
- These Terms, together with the Privacy Policy, Refund Policy, any applicable checkout disclosures, and any separate lawyer or business order terms, constitute the entire agreement between you and SafeTrip regarding the Platform.
